Terms and Conditions apply between a customer (You) and Concrete Products OÜ (hereinafter referred to as Froncrete, We or Us) org.nr. 11493187 , when You order products from FRONCRETE.
You must be minimum 18 years of age and are legally capable of entering into a binding contract to place an order. We do not accept payment from people under the age of 18 years.
We reserve the right in individual cases to deny or change your order.
All the information on our webpages, e-mails sent to You, marketing materials, campaigns etc. are protected by including intellectual property and market laws. This means that trademarks, trade names, product names, product design, images, graphics, design, layout and information about products, services and other content may not be copied or used without written consent from Froncrete.
ORDERS AND ACCEPTANCE OF TERMS
In order to use Froncrete materials and order Our products through, You must accept this Terms and Conditions, which You do by clicking “I agree to the Terms and Conditions” on the Webpage/ visiting our webpage and clicking in our shop “Confirm order”.
By clicking “Confirm purchase”, You confirm Your order of the Products placed in Your shopping cart.
Once You have clicked “Confirm purchase” (means we start processing your order) You are confirmed the Order of Froncrete products and services. You are entitled to cancel within the upcoming 48 hours after We have sent you the Order confirmation/Proforma invoice by email.
Froncrete confirms Your order only when preapproved payment has been cleared by paying the Proforma invoice sent to You by e-mail or We have received Your credit confirmation from Financial partner. Froncrete reserves the right to not always offer all payment methods.
Once You have placed Your order, we will send You an Order confirmation/Proforma invoice with final Tax and Delivery (transport cost and delivery time) to the e-mail address You registered at the check-out acknowledging and confirming the details of Your purchase. Note, it is therefore important that you enter the correct information when you place an order. We recommend that you save the confirmation to facilitate any contact with our customer services. Confirmation is also your proof that you completed your purchase. If you don’t receive an order confirmation within 48 hours please contact our support to verify your purchase.
PERSONAL DATA PROTECTION
We sell and produce our products personally to you by order: fronts, sides, tops, lists and even handles with the characteristics and to the extent set forth in time being product description available on the website. All pictures on the website must be exclusively seen as illustrations. Such illustrations cannot be guaranteed to reproduce the goods you receive, or the product’s exact appearance, features or origin. Froncrete produce the products in natural materials that may change the appearance and/or experience patina over time due to oxidation and/or normal usage. This is not caused by complaint but regarded a natural process for certain materials. If you experience a lack of information we recommend that you contact us before placing an order. Before you place an order you can always order sample details from our webpage but be aware that products we produce are always unique.
All Product prices presented on the website are presented in Euros and where applicable, prices are inclusive of VAT 20% according to the Estonian Law. VAT is not included in EU country business orders in case you have provided Us relevant information about your company tax registering. Orders to countries outside of EU may be subject to local VAT, import duties and/or taxes, which are levied once your package reaches your country. You will be responsible for payment of such import duties and taxes. Froncrete has no control over these charges and, since these charges are different for different countries, We cannot predict their amount. Please contact your local customs office for more information.
The price does not include payment fees and shipping cost, which is added separately.
Froncrete reserves the right to change the prices on the website at any time and correct any pricing errors that may occur.
The shipping cost is subject to the size, weight and Your location of the Products You ordered. The total price for the products and the shipping will be presented at the check-out. Please note that transport cost presented you in check-out process is estimated and will be presented you in Froncrete order confirmation sent to you by e-mail. The reason is that we would like to keep shipping costs as low as possible for you and we might be able to consolidate different deliveries to Your region or for bigger orders ask special transport offer from our logistics partners.
Froncrete accepts bank transfer You confirm after receiving Order Confirmation by e-mail. Please always use Order number in explanation field and reference number in reference line while doing the payment to quarantee we identify Your payment faster and Your order will be processed.
You hereby accept and agree to the fact that it is the applicable third parties payment service’s conditions that apply in its entirety when it comes to Your payment to Froncrete. If there are any problems in regards to Your payment transaction We will not be held responsible for any problems relating to payments or Your payment identification and You are directed to contact the respective payment service provider.
Froncrete provides you all necessary data for local and international bank transfers in Our Order confirmation.
Froncrete has the right to deny the order if the Order confirmation payment or other similar payment method selected by you are not approved by Froncrete. We also reserves the right to not always offer all payment methods or change the payment method if your choice of payment for some reason is not working at the time of purchase.
Froncrete reserves the right to cancel a purchase if fraud is suspected.
DELIVERY AND SHIPPING COST
We offer a range of different shipping methods and delivery terms and conditions depending on the product, the weight of your order and where you are located. Estimated delivery cost will be presented at the Check-out. Precise delivery cost and delivery time will be presented to you on the Order Confirmation by email to offer you the best possible option i.e. for bigger orders we might take you a personal shipping offer, some order to the same region can be consolidated etc.
Froncrete offers You the possibility of delivery directly to Your home address, which means as close to Your door or property line as the delivery truck can get.
Should Products not be collected, they will be returned to Froncrete nearest warehouse and for non-collected Products, We will charge you for the costs incurred in connection with the return. These costs consist of return shipping and any costs of storing Products in a warehouse before they can be returned. The cost of storing your goods in a warehouse is 50 Euro/day for deliveries of orders packed on pallets or similar goods carrier.
Should Products not be received at home delivery, they will be returned to Us and for products received by the customer Froncrete will charge you for the costs incurred in connection with the return. These costs consist of return shipping and any costs of storing Products in a warehouse before they can be returned. The cost of storing your goods in a warehouse is 50 Euro/day for deliveries of orders packed on pallets or similar goods carrier.
Products made to order will normally be shipped from the joinery after 4-6 weeks. Confirmed deliverytime will be presented on Order Confirmation sent to you by e-mail.
Unforeseen problems or delays with the manufacturing of your products may affect your delivery time. Also, holiday periods may cause longer delivery times than specified on the website. The Company will do its best to inform You about this and keep you informed about any delays concerning your delivery.
When the order leaves our production site, Froncrete will as a service to You as a customer, send out an e-mail containing a tracking link that can be used to track your order. It is Your as a customer responsibility to be aware about the shipping times and details after receiving tracking information from Froncrete by email. In any case the tracking information is not valid contact immediately Froncrete customer service.
The delivery time for Your Products should always be seen as an estimation indicating when the Product/s will be delivered. We cannot give You an exact delivery date and time for Your placed order.
Please note, changing the delivery details after receiving Order Confirmation may influence the estimated delivery time.
When You receive your delivery from Froncrete, it is up to You as a customer to urgently examine and check if the packaging and the product are damaged.
Any eventual damages on the package and/or Product must be noted on the delivery notice before the supplier leaves the point of delivery.
Any possible damages on the package and/or Product must be documented with photos, with and without the packaging, and communicated with the shipping company within 7 days of delivery.
Our liability to you for any loss or damage arising in connection with your order on the website is limited to the total amount of your order. Froncrete has no liability for indirect losses.
Should We have reason to question your ability to pay, the Company reserves the right to stop the shipment and has no obligation to make the delivery until full payment of the order has been provided to Froncrete, or until another agreement has been made.
If you wish to return any Product due to complaint, please contact Froncrete customer service via e-mail. You can also contact us by phone for assistance but official complaint will be registered in time of receiving complaint by e-mail.
Froncrete will cover any shipping cost when You return your Product due to complaint. Before sending the product, make sure your complaint has been received by email and approved by Froncrete.
You are responsible for packing the Products so it will not be damaged during transportation when you return the Product due to complaint.
If the delivery should be delayed from what has been previously stated, Froncrete will not compensate any costs for loss of earnings or compensate for hired carpenters etc. Froncrete will not be held responsible for any damage arising from the announced delivery time having been exceeded.
Consumers within EU and EEA have a 14 days right of withdrawal for goods purchased on distance from the day you received your products. This means that You as a customer must notify Froncrete that you withdraw Your purchase within 14 days from the day you received the delivery of goods, please note that Froncrete will only refund you for the products purchased not any cost associated with shipping, transportation and/or payment fees or charges. This can be made by contacting Froncrete customer service via e-mail, clearly stating that you wish to exercise the right of withdrawal.
Please note that the right of withdrawal is furthermore only applicable when purchasing goods from the regular assortment from our webpage. This means, that there is no right of withdrawal when purchasing a Product that is made to a customer unique specification, such as measures, color or milled holes according to the customer’s choice.
When exercising the right of withdrawal, reimbursement of the purchase price is made as soon as possible, however at latest 14 days after Froncrete receives the customer’s notification of withdrawal. Froncrete may withhold the payment until we have received the goods or you have proven that the goods have been sent back to us. The refund will be made to the source of original purchase unless otherwise agreed or if any issues arise.
When exercising the right of withdrawal, the customer is liable for reimbursing Froncrete for any diminished value of the Product resulting from the handling of the Product other than what is necessary. However, the customer is always entitled to control the condition of the Product upon delivery without being liable for any diminished value.
When exercising the right of withdrawal, the customer is liable for all costs related to the return freight.
Remember: Note that the return cost for shipping when invoking the right of withdrawal is likely to be more expensive than the shipping you paid to bring home the goods. This is due to the purchase of single freight services which are considerably more expensive than buying large shipping volumes. Should damage occur at such return shipping, compensation should be required from your shipping company. Therefore, look up the insurance conditions applicable to the shipping company you hire, so you know you are getting full compensation for any damage.
Since all our orders are unique we are not able to provide a rating card for return costs. If you have questions regarding how much a return freight would cost you, please contact our customer service by email, and they will do their best to provide you with an estimate.
The customer is responsible for making sure that the Product is returned in perfect condition. The Product must be returned well packaged in the same packaging it was delivered in or in packaging of equivalent quality. In case of return shipping when exercising the right of withdrawal, You are responsible for making sure that the Product is properly packaged so that the Product is not damaged during transport.
Froncrete reserves the right to refuse a return if any of the conditions stated above are not met. You bear the cost for the return freight, alternatively Froncrete may, charging an administrative fee, take care of the delivery, despite the conditions not being met.
Froncrete does not warrant that quality, suitability or usage of the Products conform to Your expectations.
Froncrete is liable for the Products until they have reached the delivery address or to the extent permitted by local law.
LIMITS ON OUR LIABILITY
Froncrete is not liable for any damages or any costs that occur in conjunction with mounting and usage of Our Products.
Froncrete is not liable for any damages or any costs that is a consequence of typographical errors or outdated information on the website or to the extent permitted by local law.
You notice and understand that there is a applicable third party supplier of payment service, which conditions fully apply on Your payment to Froncrete. In case of problems with a payment, Froncrete shall not be held responsible for this.
In event of war, strike, riot, cataclysm, significant increase of the prices at the world market, failure of electrical / telecommunications / data communications or other communications, as well as defects or delays in services from subcontractors or comparable events beyond the control of Froncrete due to circumstances stated herein, We will be able to apply themselves to force majeure. These circumstances shall then constitute grounds for freedom from liability and other sanctions, Froncrete is then exempted from its obligations to fulfil these Terms. If this occurs, we will try to inform you.
These Terms shall be governed and construed in accordance with the laws of Estonia. To the extent the law allows, Estonian courts have exclusive jurisdiction regarding disputes arising out of these Terms or your use of the website, with the exception of cases where Froncrete voluntarily choose to take legal action against a customer or user where it has residence.
Any dispute, controversy or claim arising out of or in connection with this terms, or the breach, termination or invalidity thereof, shall be finally settled by Estonian County Court to the extent the law allows.
CHANGES TO THE TERMS
Froncrete reserves the right to modify these Terms at any time. Any changes to these Terms will be posted on the website under section Terms and Conditions. Changes apply from the time you have accepted the Terms (in conjunction with any new purchase or visits to the website), or 60 days after we have informed you about the changes. Froncrete recommends that you keep yourself updated on the website regularly to be aware of any changes to the Terms and Conditions.
If the competent court, authority or arbitral tribunal finds that any provision of these Terms is invalid or unenforceable, the provision in question and all other provisions remain valid and enforceable to the extent permitted by applicable law. The provisions declared invalid or unenforceable will be replaced by relevant legal guidance and advice.
